Summary of Position

The Teladoc Health Legal Department has global responsibility for all legal matters (including privacy and public tendering), product counselling for innovative tech solutions, government affairs advocacy, compliance and regulatory. This is a senior-level position, co-reporting to the Head of the International Legal Department and Managing Director of Canada. The role is primary point of contact for any said legal matter related to Teladoc Health Canada for multiple areas of law, including contracts, marketing and creative vendor contracting, product counselling, data privacy, litigation, IP, medical practice, government affairs, employment, regulatory, compliance and general corporate. Independent management of outside counsel is integral to the position, as well as hands-on production of work product

Essential Duties and Responsibilities

General Duties:

  • Manage a diverse set of legal issues/projects in collaboration with all departments of the Company.
  • Manage outside counsel with respect to assigned matters.
  • Facilitate interaction between the business units directors/managers of the Company and other members of the Legal Department (Privacy, Compliance, Regulatory, Intellectual Property, etc.) for relevant legal matters.
  • Provide counsel and produce attorney work product in response to Company’s needs.
  • Implement the different legal, regulatory, privacy and compliance programs or initiatives that might come from Legal Department.
  • Collaborate closely with the Data Privacy Officer of the Company and, therefore, performed said role as per applicable laws and consistent with Teladoc Health Privacy Program.

Particular Duties:

Due to the nature of the activities of the Company, the following are specific relevant duties for prioritization:

  • Jointly with the relevant departments and business units (as applicable), lead the legal/regulatory strategy for the introduction and commercialization of new products and App features, and medical devices in Canada.
  • Review and consider jurisdictional provider/technology platform or other business licensing requirements within Canada and globally, as required from time to time.
  • Consider and advise around French language requirements for members, visitors, clients, employees and other stakeholders.
  • Draft, review, negotiate and/or provide advice on any relevant contract to the Company, marketing and creative vendor contracting, litigation, IP, medical practice, government affairs, employment, regulatory, compliance and general corporate. These duties might be performed directly by the lawyer or in coordination with other members of the Legal Department
  • Jointly with Privacy colleagues and the Operations and IT departments, maintain and adapt as per local legal needs Company’s privacy program within the scope of the company Global Privacy Program and in collaboration with the Privacy colleagues; perform internal training and relevant internal monitoring activities on privacy; perform relevant Privacy Impact Assessments and lead the management of privacy incidents as per policies and procedures and coordinate with relevant departments.

Qualifications Expected for Position

  • Bilingualism in English and French
  • Legal Degree and Canada Qualified Lawyer -appropriate license(s)
  • Minimum of 6-8 years of practice and, at least, 3-5 years experience in life science
  • Experience working within a highly regulated industry in Canada.
  • Strong knowledge and experience in implementing and managing daily management of data protection duties
  • Experience at multinational company or law firm is a plus.
  • Experienced in negotiating and closing commercial agreements, experience with marketing, acquisition and creative partnerships a plus but not essential.
  • High knowledge and experience on healthcare and/or privacy laws and regulations. Knowledge and experience with public tendering laws.
  • Ability to work across multiple product offerings and advise in data protection and privacy regulatory and compliance matters.
  • Ability to earn buy-in from business partners through a solution oriented mindset.
  • Some experience with digital marketing from a legal perspective or accustomed to advising agile, product-forward, consumer facing businesses.
  • Risk management skills : risk evaluator and, if applicable, co-decision taker in the area of the role proposing clear pathways to reduce or maximize mitigation of risks. This includes being available to advice and navigate in situations with no clear legal framework or changeable environment.
  • Excellent written and verbal communication skills to various levels of the company while also synthesizing complex situations for business partners.
  • Experience interfacing with executive management.
  • Ability to prepare and deliver training sessions.
  • Ability to work in fast paced, dynamic, hands-on manner, respond to questions from business areas and work in an organization with a complex, multi-national subsidiary structure.
  • Respect for diversity and ideas of others; willingness to collaborate in a fast-paced team environment with effective consultative and influencing skills.
  • Integrity and strong interpersonal skills are essential to success. Hands-on person understanding the different level of the activities assigned to the position.
